    Asprey: Fifth Avenue Flagship

    Asprey hired LePatner to assist it in constructing it's flagship retail store in Trump Tower on Fifth Avenue. LePatner drafted and negotiated Asprey's construction provisions in it's lease, including complex insurance negotiations that allowed Asprey to relocate one of Trump Tower's primary structural columns to accomodate Sir Norman Foster's unique design.

    Rosewood Hotels & Resorts

    Rosewood hired LePatner to produce a PCA of the hotel to increase it's negotiating position with the seller. The PCA allowed the client to purchase sevewral million below the asking price.

    After Rosewood purchased The Carlyle, It instructed LePatner to oversee its landmarked facade restoration and resolve discrepancies in the Hotel's Certificate of Occupancy

    LePatner managed the fast-tracked, multi-phase renovation of the facility to minimize business impacts and inconvenience to customers. LePatner also recovered significant sums from the Boathouse's insurer following extensive property damage from heavy snow that collapsed part of the Boathouse during renovations.

    LePatner represented conEdison for the reconstruction of it's substation at 7 World Trade Center, the first new construction to arise from Ground Zero.

    The design and construction agreements required key provisions coordinating conEdision's complex substation design with the superstructure of the new building and the lease between conEdision and Silverstein.

    Spread over five floors, the Club contains a screening room, restaurant and lounge, fitness center, library and full service spa. LePatner guided the team to timely issue construction documents and estimates, oversaw the C.M. selection process, prepaired contracts, provided on-site project management throughout construction, and developed strategies to overcome major delays caused by the landlord's core and shell work. Despite the obstacles, LePatner ensured that the Club opened legally prior to the landlord obtaining its TCO.

    LePatner was retained by a developer who faced questionable claims and changed orders from it's construction manager.LePatner worked with the project team and the owner to sift through the myriad construction documents to find the information needed to create a strong defense to the claims.

    LePatner prepared a Web-Based dynamic mediation presentation that allowed the owner's team to present synthesized arguments quickly or expand a topic and argue their case seamlessly with backup documentation and supporting exhibits literally only a mouse-click away. The presentation kept the adversary on the defensive, and resulted in a quick favorable resolution for the owner.

    LePatner drafted the design and construction agreements for the investment banking firm's billion dollar financial services headquarters in Jersey City. LePatner worked closely with the firm's general counsel and corporate counsel to develop a comprehensive set of seamless agreements between the firm and it's project manager, architects, engineers, and design consultants. LePatner researched and recomended inclusion of an Owner Controled Insurance Policy (OCIP) that provided maximum protection and control to the owner.

    Highline Park

    LePatner served as pro bono counsel for Friends of the Highline, the grassroots organization tat is credited with recognizing the untapped beauty and potential of the abandoned elevated railway on the lower west side of Manhattan and reclaiming it as a linear pedestrian park for the 21st century. Working with the City, FHL selected a design team in 2004 after an open design competition.

    LePatner worked with the FHL to review construction bids for the project, then drafted the construction agreement. To insulate FHL from liability, LePatner negotiated key provisions that addressed existing structural conditions and new connections to the street, interfacing with City agencies, and funding mechanisms.

    Instituto Cervantes

    The Spanish Government retained LePatner to oversee the relocation of it's premier cultural institution in New York to a property surrounding the landmark Astor Yard a few blocks from the United Nations.

    LePatner drafted the construction agreements, represented the owner at commuity board and Landmark Commission meetings, overcame their initial opposition to the project and established and oversaw a rigorous completion schedule achieved by all the contractors in time for the facility to be dedicated by Spain's Prince Phillip as originally scheduled.

    MNB hired LePatner to oversee the design and construction of a banking and lending branch occupying a multi-level retail space in an old residential building. LePatner provided day-to-day oversignt of the project team during design and construction and coordinated multiple vendors contracted by the owner, including the critical security vendor.

    LePatner anticipated potential delays and mitigated them through intense follow through with the project team. The project completed on budget despite the discovery of concealed site conditions and permit delays.

    Pathway 2000 Campus Expansion

    The Osborn, a premier retirement facility in Rye, New York, retained LePatner for its $150 million Pathway 2000 expansion project. LePatner guided the client through a complex development process to establish business and financial parameters, identified the design and construction team, and prepared an interlocking series of agreements.

    Complex multi-party litigation ensued when poor workmanship led to significant water and mold damage just prior to project completion. LePatner recovered from the insurers and is seeking aditional damages from the contractors for the resulting delays and cost overruns.

    W. Hotels

    Starwood retained LePatner to assist it in converting a historic midtown hotel into the first W Hotel in the country while keeping the hotel open for busienss.

    LePatner helped Starwood prepare the RFP's for the design and construction team and negotiated contracts for each. Starwood tasked LePatner to manage the project, oversee the budget and coordinate the phased renovation. LePatner subsequently prepared model contracts as Starwood developed other W. Hotels across the nation.

    WLIW Broadcast Studio Renovation

LePatner assisted EBC/WLIW in the purchase and closing of the WLIW site from the county by drafting and reviewing contract provisions pertaining to easements, zoning changes, utility work and other construction-related items.

    LePatner is currently managing the full renovation of WLIW's studios and offices into a state of the art broadcast and disaster recovery facility. LePatner helped the client develop a program and is leading efforts for the project to achieve LEED certification.
